As the number of COVID-19 cases has grown nationwide, it is not been a surprise to most employers that lawsuits were not too far behind. Unfortunately, that scenario has proved true as more and more lawsuits are being filed against employees based on claims associated with the COVID-19 pandemic.

One of the first cases involving COVID-19 was brought as a wrongful death action against Walmart for the death of one of its employees in Illinois. It is clear that more and more plaintiffs’ lawyers are going to be focusing on employees who are hospitalized as well as, those who have died by trying to get around the Worker's Comp protection for employers and bring a wrongful death suit against the employer.

In addition to wrongful death lawsuits, employers are now being served with personal injury lawsuits for failing to provide proper protection of its employees to the COVID-19 virus while at work.
