Congress passed Title VII in 1964 prohibiting discrimination in the workplace due to race, color, gender, national origin, and religion. The addition of the word “gender,” or “sex,” was considered to be a joke and was thought to derail the controversial statute. With this said, Congress probably never envisioned that “sexual harassment” would be a source of contention in the courts. It took the Supreme Court until 1986 to confirm that sexual harassment was a form of discrimination on the basis of sex. More than 30 years since, we are seeing sexual harassment grabbing the headlines at an unprecedented rate. Sexual harassment claims are ending careers of many notable chief executive officers, entertainers, and journalists, such as Harvey Weinstein, Bill O’Reilly, Kevin Spacey, and Matt Lauer, just to name a few.
We are learning that sexual harassment occurs at all levels in the workplace and that it is still a huge problem. Now is the time for all employers to reassess their policies and procedures so that they are vigilant about sexual harassment compliance and about protecting their employees.
