On August 1, 2023, the USCIS published a Revised Form I-9, Employment Eligibility Verification, along with several rules changes. Employer will be able to use the current form without penalty through the end of October, but after Oct. 31, 2023, the prior version of Form I-9 will be obsolete and no longer valid for use.
The USCIS states that, “The newly updated Form I-9 contains myriad revisions to the form and its instructions to streamline these materials and reduce employer and employee burden associated with the form.” The revised Form I-9 reduces Sections 1 and 2 to a single-sided sheet and is designed to be a fillable form on tablets and mobile devices. It also revised the list of acceptable documents to include some acceptable receipts, aswell as provide guidance and links to information on automatic extensions of employment authorization documentation. Additionally, the U.S. Department of Homeland Security (DHS) issued a final rule allowing E-Verify employers to remotely examine Form I-9 verification documents. The new form I-9 subsequently has a checkbox to indicate when an employee’s Form I-9 documentation was examined using a DHS-authorized alternative procedure.
